A group of residents has concerns about the “Patriot Academy” located on U.S. Highway 87 in Kendall County, between Comfort and Fredericksburg.
The Patriot Academy has had a negative effect on its neighbors. It has opened a firing range at their location. Some of its neighbors have changed their daily lives due to the noise of the gunfire. Some days, these residents are forced to curtail their time outside their homes due to the noise.
There is a strong possibility these activities are having a negative effect on property values. The Academy has created a public nuisance.
What about lead contamination? Is there a proper cleanup being done? Will this lead leech into the water table?
Is there enough ground water to support the city? Will the water use have a detrimental effect on the water table in the area, thereby negatively impacting residents?
Is there enough electrical service to meet the demand? What will be done with sewage?
To our understanding, the issue of incorporation of this city will only be voted upon by the residents of the proposed city. How can this be legitimate?
The residents are family and staff members of the Academy. The mayor and city council will basically be elected by Rick Green, the owner. This creates an environment to circumvent the system, as they are highly likely to do Mr. Green’s bidding.
By state law, an incorporated city is granted extraterritorial jurisdiction of a half-mile radius. That gives the “City” authority over its neighbors.
Mr. Green states that he will cede authority to Kendall County. Is that legal? If he changes his mind in the future, can he regain that authority?
If the city is sold or passed on to heirs, will they be able to regain the ETJ if they so desire?
