A son accused of burglarizing his mother’s house and threatening her is being grounded by the state for up to 14 years in prison.
Russell Niemeier, 55, of Boerne received the sentence on a charge of burglary of a habitation May 8 in the 451st state District Court by visiting Judge Melvin “Rex” Emerson.
The case stems from a call Boerne police made July 14, 2024, in which an intruder used a knife to enter the back of a home. Investigators said a suspect intending to commit theft unlawfully entered a residence belonging to his mother.
According to prosecutors, evidence indicated that after the man forcibly entered the residence, he confronted the victim and threatened her, causing the mom to fear for her safety.
The victim told officers she was so afraid she began placing cans in front of her door at night, to alert her if he attempted to break in.
At the time of his arrest, Niemeier possessed a small hatchet and a folding knife, and a multi-tool was found in his vehicle, officers said.
A pre-sentence report by Kendall County Adult Probation Officer Jeneive Casarez detailed Niemeier’s prior brushes with the law, which included a conviction on a charge of injury to a child/elderly/ disabled in Kendall County in October 2017.
Investigators said that incident stemmed from the assault of an elderly individual. That report also showed Niemeier with four previous convictions.
Casarez recommended the court impose a 14-year sentence in the latest case, which was prosecuted by Assistant Criminal District Attorney Andrew Field, officials said.
