Fire conditions bring out ‘disaster declaration’

Outdoor burning banned through Feb.18

Outdoor burning in the county is banned at least until Wednesday after Kendall County Judge Shane Stolarczyk signed a local disaster declaration.

Commissioners Court will revisit the issue Feb. 18, officials said.

The declaration was brought to the judge Feb. 11 by Fire Marshal Brady Constantine for Stolarczyk’s signature, on the heels of county fire departments dealing with blazes across the county.

The ban lasts seven days “in order to mitigate the hazard posed by wildfire, by curtailing the practice of outdoor burning” on a temporary basis, according to the language of the declaration.

Constantine said a special meeting of the commissioners is needed to enact a full-blown burn ban prior to the declaration expiration 4 p.m. Feb. 18.

The order can only be extended by a vote of the commissioners.

Despite precipitation delivered by Winter Storm Fern a few weeks ago, the area’s continuing lack of rainfall adds to drought conditions and the threat of conflagrations, officials said.

Through Tuesday, there can be no outdoor burning of any kind, the fire marshal said. Violation of the order is a Class C misdemeanor, punishable by a fine up to $500 or a jail term not to exceed 180 days.
