Man facing sex assault charges bound over after jumping bail

A 31-year-old San Antonio resident, Xavier “Saber” Murillo Ardon, found himself back behind bars for the third time on the same felony charges after failing to appear in court.

Ardon, facing two counts of bail jumping and two counts of aggravated sexual assault against a child, was booked Aug. 18 after failing to appear in court for the second time.

“On this the 16 day of August, 2023, came to be heard the above motion of the state requesting a revocation and increase in bond and it appeared that such increase should be granted,” a motion filed last week in the 451st state District Court read.

451st District Judge Kirsten Cohoon granted Kendall County Assistant District Attorney Gretchen Flader’s motion to revoke Ardon’s bond, keeping the defendant in custody until his trial date or case resolution.

This isn’t the first time Ardon has been nicked for failing to appear for his court dates.

The bail jumper was charged with two felony counts of failure to appear Nov. 2, 2021, after he failed to show up before Cohoon the previous month.

“After having been lawfully released from custody with bail, on condition that he would subsequently appear in the 451st Judicial District Court … on the 14th of October 2021, where he was charged…” the bail jumping indictment reads, placing two new, $10,000 bail amounts for Ardon’s release.

He met that $20,000 bond but failed to appear yet again, granting him residence in the Kendall County Jail this time around, until his case is resolved.

The charges that led to his imprisonment stem from 2020. A 16-year-old, Spanish- speaking student said an adult man with family ties, Ardon, had sex with her.

According to the original arrest warrant – signed by Precinct 3 Justice of the Peace Debby Hudson and sworn to by Kendall County Sheriff’s Office Investigator James Walters – the teenage girl indicated to a teaching assistant at her school that she may have suffered from neglectful supervision, sexual abuse and labor or sex trafficking.

When first interviewed by law enforcement, the girl denied the allegations. But upon further investigation with detectives and school resource officers and school staff to translate, the story unfolded.

“After continued questioning, she told them she had sex with (Ardon) twice,” the warrant affidavit reads. “She didn’t know where he took her, but it was close to Boerne and at the same place both times. The second time, she did not want to have sex with him, but he threatened to kill her family if she did not.”

Fearing for her family’s safety, the girl said she participated in sexual activity with Ardon while she was a teenager attending a local high school.

Ardon is facing two first-degree felony charges of sexual assault of a child and two third-degree felony charges of bail jumping.

Pending his trial, he may face between five and 99 years in state prison if found guilty of the sexual assault accusations.
